Le Gouvernement de la République du Burundi a reçu un financement de la Banque mondiale pour couvrir le coût du Projet de Facilitation du Commerce et Intégration dans la région des Grands Lacs (PFCIGL) et a l’intention d’affecter une partie du produit à des services de consultant.

Les services de consultant (« les Services ») comprennent :

Sous la supervision de l’Unité de Gestion du Projet (UGP), le Consultant sera chargé de :

• Procéder à l’inventaire et à la compilation des textes juridiques et réglementaires nationaux et internationaux ;
• Faire un schéma qui montre l’intégralité des textes et normes qui s’appliquent au commerce frontalier ; un schéma permet de visualiser rapidement le nombre de normes et les incohérences entre les différentes règles.
• Analyser les différents textes en vue d’identifier les lacunes, les vides et les incohérences juridiques, ainsi que l’état de mise en application par rapport aux standards régionaux ;
• Soumettre des recommandations précises et détaillées pour l’harmonisation de ces textes avec les standards internationaux ;
• Présenter un rapport préliminaire et le recueil des textes lors d’un atelier de validation regroupant les parties concernées (Ministère du Commerce, du Transport, de l’Industrie et du Tourisme, l’Office Burundais des Recettes, le Commissariat Général des Migrations, l’Autorité Maritime, Portuaire du Burundi (AMPB), Bureau Burundais de Normalisation et Contrôle de la Qualité (BBN), Ministère de l’Environnement, de l’Agriculture et de l’Elevage Ministère des Finances, du Budget et de la Planification Economique;…)
• Elaborer un rapport final, intégrant les recommandations de l’atelier.

La mission du Consultant va s’étendre sur une période de 3 mois avec une charge de travail maximum estimé à 40 hommes/jours débutant le 20/03/2024.

L’Unité de Gestion du PFCIGL invite dès à présent les consultants individuels admissibles (« Consultants ») à faire part de leur intérêt à fournir les Services. Les Consultants intéressés doivent fournir des informations démontrant qu’ils possèdent les qualifications requises et l’expérience pertinente pour exécuter les Services. Les critères de sélection d’une liste restreinte sont les suivants :

Le Consultant devra avoir les qualifications suivantes :

• Etre titulaire d’au moins un diplôme universitaire (BAC +5) en sciences juridiques, droit commercial, droit des affaires, droit international ou droit en commerce international ;
• Avoir au moins douze (12) ans d’expérience en droit commercial international, en particulier dans le domaine du commerce transfrontalier ;
• Avoir une expérience avérée des cadres réglementaires et procédures sur le commerce transfrontalier, et en particulier dans la Région des Grands Lacs ;
• Avoir une expérience au sein d’une organisation d’intégration régionale ou internationale s’occupant de coopération douanière ou de commerce international ;
• Avoir déjà réalisé des études similaires ;
• Avoir une parfaite maitrise de la langue française et une bonne connaissance de l’anglais.

L’attention des Consultants intéressés est attirée sur la Section III, paragraphes, 3.14, 3.16 et 3.17 du « Règlement de Passation des Marchés pour les Emprunteurs de FPI » de la Banque mondiale, juillet 2016, révisé en novembre 2017, août 2018 et novembre 2020 (« Règlement de Passation des Marchés»), qui énonce la politique de la Banque mondiale en matière de conflits d’intérêts.

Un Consultant sera sélectionné selon la méthode de Sélection de Consultants Individuels décrites dans le Règlement de Passation des Marchés et qui sera expressément énoncé dans la Demande de Propositions.

The Government of the Republic of Burundi has received funding from the World Bank to cover the cost of the Trade Facilitation and Integration Project in the Great Lakes Region (PFCIGL) and intends to allocate part of the proceeds to consulting services.

Consulting services (“the Services”) include:

Under the supervision of the Project Management Unit (PMU), the Consultant will be responsible for:

• Carry out the inventory and compilation of national and international legal and regulatory texts;

• Make a diagram showing all the texts and standards that apply to border trade; a diagram allows you to quickly visualize the number of standards and the inconsistencies between the different rules.

• Analyze the different texts with a view to identifying gaps, gaps and legal inconsistencies, as well as the state of implementation in relation to regional standards;

• Submit precise and detailed recommendations for the harmonization of these texts with international standards;

• Present a preliminary report and the collection of texts during a validation workshop bringing together the parties concerned (Ministry of Commerce, Transport, Industry and Tourism, the Burundian Revenue Office, the General Commission for Migration, the Burundi Maritime and Port Authority (AMPB), Burundian Bureau of Standardization and Quality Control (BBN), Ministry of Environment, Agriculture and Livestock Ministry of Finance, Budget and Planning Economic;…)

The Consultant's mission will extend over a period of 3 months with a maximum workload estimated at 40 man/days starting on 03/20/2024.

The PFCIGL Management Unit now invites eligible individual consultants (“Consultants”) to express their interest in providing the Services. Interested Consultants must provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The criteria for selecting a shortlist are as follows:

The Consultant must have the following qualifications:

• Hold at least a university degree (BAC +5) in legal sciences, commercial law, business law, international law or international trade law;

• Have at least twelve (12) years of experience in international commercial law, particularly in the area of cross-border trade;

• Have proven experience of regulatory frameworks and procedures on cross-border trade, and in particular in the Great Lakes Region;

• Have experience within a regional or international integration organization dealing with customs cooperation or international trade;

• Have already carried out similar studies;

• Have a perfect command of the French language and a good knowledge of English.

The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16 and 3.17 of the World Bank “Procurement Regulations for REIT Borrowers”, July 2016, revised in November 2017, August 2018 and November 2020 (“Procurement Regulations”), which sets out the World Bank’s policy on conflicts of interest.

A Consultant will be selected using the Individual Consultant Selection method described in the Procurement Regulations and which will be expressly set out in the Request for Proposals.
