م/ مناقصة رقم (15) لسنة 2024 اعادة اعلان ((مشروع نقل وصيانة ونصب تشغيل مجمع ماء البدران سعة 200م3/سا)
1 يسر ديوان محافظة بغداد الإعلان عن مناقصة ) مشروع نقل وصيانة ونصب تشغيل مجمع ماء البدران سعة 200م3/سا) ضمن المشاريع والاعمال المشمولة بقانون الدعم الطارئ للأمن الغذائي والتنمية /من تمويل تنمية الاقاليم) بالتبويب(49-1-4-13-18-218) والتي سبق وان تم الإعلان عنها بموجب المناقصة (29) لسنة 2023 فعلى كافة مقدمي العطاءات من الشركات والمقاولين المصنفين المؤهلين وذوي الخبرة والاختصاص تقديم عطاءاتهم لتنفيذ المشروع وحسب الوثائق القياسية .
2على مقدمي العطاءات المؤهلين والراغبين في الحصول على الوثائق الخاصة بالمشروع وجداول الكميات ومعلومات اضافية مراجعة محافظة بغداد الطابق الثامن / قسم العقود خلال أوقات الدوام الرسمي .
3يجب ان يتضمن العرض ثلاث ظروف/

ظرف يتضمن متطلبات التأهيل المطلوبة (شهادة تأسيس الشركة مصدقة من دائرة مسجل الشركات في وزارة التجارة, عقد تأسيس , محضر اجتماع , إجازة ممارسة مهنه, هوية تصنيف بدرجـــــــه عاشرة ( إنشائية، كهربائية) نافذة صادرة من وزارة التخطيط ، هوية غرفة تجارة نافذة , تقديم أعمال مماثله مصدقة من الجهة المستفيدة, تقديم مستمسكات المدير المفوض , تقديم ما يؤيد حجب البطاقة التموينية , كتاب عدم ممانعة صادر من الهيئة العامة للضرائب نافذ الصلاحية عند تاريخ الغلق ويحمل رمز التحقق QR, وصل الشراء النسخة الأصلية , يتم التوقيع والختم على كافة صفحات جداول الكميات من قبل الشركة المتقدمة , تقديم جدول تقدم عمل , تكون مدة نفاذية العطاء 120 يوما , تقوم الشركة بتثبيت عنوان متكامل لمكتبها(محلة, زقاق ,دار) مع أرقام الهواتف والموقع الالكتروني الخاص بها , يجب إن تكون الأرقام مدونة رقما وكتابة وان تكون الكتابة واضحة وخالية من الحك والشطب ومقترن بتوقيع مقدم العطاء على الشركات المسجلة في اقليم كردستان تقديم كتاب اعتماد اولياتها صادر عن وزارة التجارة دائرة تسجيل الشركات , (على الشركات الأجنبية الراغبة بالاشتراك بالمناقصة تقديم شهادة تأسيس وكافة مستمسكاتها مترجمة مصدقة من السفارة العراقية في بلد التأسيس , مع ما يؤيد فتح فرع للشركة في العراق , تلتزم الشركات الأجنبية غير المسجلة في العراق التي ترغب بتقديم عطائها بتسجيل فرع لها في العراق وفق ( نظام التعديل الأول لنظام فروع الشركات الأجنبية رقم 4 لسنة 2023 خلال مدة (15) خمسة عشر يوم من تاريخ تبليغ الشركة الأجنبية بكتاب الإحالة و بخلافه تعد ناكله)) , تلتزم الشركة بتقديم الأسعار النهائية , تقديم جدول الكميات مختوم بالختم الحراري لمحافظة بغداد )
4 بإمكان مقدمي العطاء المهتمين شراء وثائق المناقصة بعد تقديم طلب تحريري من المدير المفوض للشركة او وكيله إلى العنوان التالي )محافظة بغداد/ قسم العقود) وبعد دفع قيمة البيع للوثائق لقاء مبلغ قدره (638,468) ( ستمائة وثمانية وثلاثون الف واربعمائة وثمانية وستون دينار عراقي) غير قابله للرد
5 يتم تسليم العطاءات / إلى العنوان التالي محافظة بغداد / قسم العقود /الطابق الثامن وأخر موعد لتسليم العطاءات الساعة 11 صباحاً من التوقيت المحلي لمدينة بغداد يوم الخميس 8 / 8 /2024 وسوف ترفض العطاءات المتأخرة عن هذا الموعد وسيتم فتح العطاءات بحضور مقدمي العطاءات او ممثليهم الراغبين بالحضور في محافظة بغداد / قسم العقود الساعة 11 صباحاً من يوم الخميس 8 / 8 /2024 وبخلافه لا يحق للشركة الاعتراض على اجراءات فتح العطاءات
6يجب إن تتضمن العطاءات ضمان للعطاء على شكل( خطاب ضمان او صك مصدق او سفتجة) صادر من احد مصارف بغداد المعتمدة لدى البنك المركزي على ان يكون الضمان المقدم داخل ضمن المنصة الالكترونية واذا لم يكون خطاب الضمان داخل ضمن المنصة يهمل العطاء وحسب تعليمات البنك المركزي.
7 تتحمل الشركة المتعاقدة كافة الرسوم والضرائب المشار إليها في القوانين والأنظمة والتعليمات العراقية
8 أذا صادف موعد غلق المناقصة عطلة رسمية فيكون موعد الغلق باليوم التالي
9. جهة التعاقد غير ملزمة بقبول أوطأ العطاءات ويستبعد أي عطاء لم ينظم حسب الوثيقة القياسية وبضمنها (السيولة النقدية, الإعمال المماثلة)
10.للمعلومات تتم المراسلة عبر البريد الالكتروني (con@baghdad.iq)
11. يتحمل من ترسو عليه المناقصة أجور النشر والإعلان.
12.في حال وجود مخالفات يتم توجيه الانذارات للشركة التي يحال بعهدتها اعمال المناقصة عن طريق قسم الشؤون القانونية في محافظة بغداد دون الرجوع الى دائرة كاتب العدل.
13.لاتتم مطالبة المحافظة بكتاب تسهيل مهمة من الكمارك وكذلك الضريبة واجازة الاستيراد ويتحمل المشترك في المناقصة مسؤولية تجهيز وايصال المواد الى المحافظة
14.يتم اعتماد (وثيقة الاشغال الصغيرة) الصادرة من وزارة التخطيط وتكون العطاءات المقدمة من المناقصين مستجيبة عند تلبيتها لمعايير التأهيل المحددة فيها بفروعها كافة والشروط القانونية والمالية المطلوبة في شروط المناقصة وفي حال عدم التزام مقدم العطاء بما تتطلبة الوثيقة المشار اليها انفا بكافة اقسامها فانه يتم استبعاد عطاءه مما يقتضي مراعاة ذلك عند التقديم.
15.للدائرة الحق في الغاء المناقصة في أي مرحلة من مراحلها وقبل الاحالة وعدم اجراء المفاضلة وحسب مقتضيات المصلحة العامة ولا يحق للمشتركين في المناقصة المطالبة باي تعويض جراء ذلك.
16.على الشركة التي يحال اليها المشروع تقديم خطاب ضمان حسن تنفيذ او صك مصدق بقيمة 5%من مبلغ العقد ويكون الخطاب نافدا طلية مدة التنفيذ والصيانة ومدرج على المنصة الالكترونية للبنك المركزي
17 . يعقد المؤتمر الخاص بالمشروع يوم الخميس بتاريخ 1 / 8 /2024 في قسم العقود الساعة العاشرة صباحا لذا اقتضى التنويه
18. على مقدمي العطاءات تقديم نسخ اضافية من كافة اوراق العطاء طبق الاصل عدد (2) اضافة الى النسخة الاصلية وتكون جميع النسخ موقعه ومختومة بالختم الحي للشركة و يتم وضع النسخة الاصلية في(غلاف منفصل) ويتم تأشيرة بعبارة نسخة اصلية ووضع كل نسخة من النسخ الاضافية ال(2) في غلاف منفصل يتم تأشير كل مغلف بعبارة نسخة اضافية وتوضع جميع المغلفات (الاصلية والاضافية ) في مغلف واحد عملا بما جاء بكتاب وزارة التخطيط المرقم 4/7/17598 في 30/6/2022
19. . لا يحق للشركات التي لديها 3 عقود او اكثر (مازالت بالتنفيذ في نفس جهة التعاقد) الاشتراك بهذه المناقصة استنادا الى ما جاء بكتاب وزارة التخطيط /دائرة العقود الحكومية العامة /قسم الاستشارات والتدريب المرقم 4/7/25524 في 27/09/2022
20.يجب ان يكون العطاء مفهرس مع خلاصة تتضمن محتويات العطاء مع ترقيم جميع اوراق العطاء
21.في حالة المشاركة لأكثر من شركة او مقاول في التقديم للاشتراك في تنفيذ المناقصات فتكون مسؤوليتهم تضامنية تكافلية في ذلك واضافة الى المعايير الواردة في الفقرات اعلاه فيتم مراعاة ما يلي :-
ا- تقديم عقد مشاركة مصدق اصوليا مع العطاء او نموذج اتفاق اولي على الشراكة موقع من قبل اطراف الشراكة معزز بتعهد من قبلهم بعدم التنازل او الانسحاب في حال رسو المناقصة عليهما على ان يتم تقديم عقد الشراكة بينهما مصدق اصوليا بعد توقيع العقد
ب- تعتمد نسبة الشراكة بين الشركاء وحسب ما محدد في عقد الشراكة وفي حال لم تذكر النسبة في عقد الشراكة فيتم القسمة بينهم على عدد الشركاء بالتساوي و يعتمد عقد الشراكة المبرم بينهما على ان يكون مصادق من كاتب العدل المختص.
ج- يمكن تقديم التأمينات الاولية باسم اي من الشركاء .
د- في حال تقديم احد الشركاء لأي المعايير المطلوبة وتم استيفائها من قبله فيتم قبول العطاء المشترك دون النظر الى الشريك الاخر الا اذا نص الوثيقة القياسية على نسب وشروط معينة ينبغي توفرها في الشريك عند ذلك يعتمد ما تم تثبيته في الوثيقة.
هـ- على جميع الشركاء تقديم براءة الذمة من الضريبة عند الاشتراك في المناقصات ولا يتم الاكتفاء بتقديم احد الشركاء لها .
و -على جميع الشركاء ان يكونوا مؤهلين من حيث سلامة الموقف القانوني لهم من ناحية الادراج في القائمة السوداء او المتلكئة او ممن يحظر التعامل معهم بموجب القوانين والتشريعات

1 The Baghdad Governorate Diwan is pleased to announce the tender for the project of transferring, maintaining, installing and operating the Badran Water Complex with a capacity of 200 m3/hour, within the projects and works covered by the Emergency Support Law for Food Security and Development / from Regional Development Financing) under the classification (49-1-4-13-18-218), which was previously announced under Tender (29) for the year 2023. All bidders from qualified, experienced and specialized classified companies and contractors must submit their bids to implement the project according to the standard documents.
2- Qualified bidders who wish to obtain project documents, bills of quantities and additional information should visit Baghdad Governorate, 8th floor/Contracts Department during official working hours.

5 Bids shall be submitted to the following address: Baghdad Governorate / Contracts Department / Eighth Floor. The last date for submitting bids is 11:00 AM local time in Baghdad on Thursday 8/8/2024. Bids late after this date will be rejected. Bids will be opened in the presence of bidders or their representatives who wish to attend in Baghdad Governorate / Contracts Department at 11:00 AM on Thursday 8/8/2024. B- The partnership percentage between the partners depends on what is specified in the partnership contract. C- Initial insurance can be submitted in the name of any of the partners.

E- All partners must submit a tax clearance certificate when participating in tenders, and it is not sufficient for one partner to submit it.
