1. एनएचपीसी लिमिटेड (भारत सरकार का उद्यम) की ओर से ऑनलाइन "आइटम दर/प्रतिशत दर" बोलियों को एकल चरण में घरेलू प्रतिस्पर्धी बोली के माध्यम से दो भाग बोली-प्रक्रिया {अर्थार्थ पार्ट-I (कवर-I): तकनीकी बिड एवं पार्ट-II (कवर-II): वित्तीय बिड} के आधार पर “प्रोजेक्ट हॉस्पिटल, कोम-कैराप, लोकटक पावर स्टेशन के लिए गहरे दफन गड्ढों और तेज कचरे के लिए सुरक्षित गड्ढों का निर्माण” हेतु योग्य sole bidders से बोली आमंत्रित की जाती है।

Bank guarantee shall be valid upto three months beyond the Bid validity period as per format appended as Form-2 of SECTION-V OR, in the form of irrevocable Insurance Surety Bond issued by any Indian Insurance Company registered under Insurance Act 1938 or as amended from time to time and approved by the Insurance Regulatory Development Authority of India (IRDAI). Bank Guarantee/ Insurance Surety Bond shall be valid upto 03 (three) months beyond the bid validity period as per prescribed format Form-3 of SECTION-V

1.1 पूर्ण बोली दस्तावेजों/ निविदा दस्तावेज केंद्रीय सार्वजनिक खरीद पोर्टल (CPPP) http://eprocure.gov.in/eprocure/app से देखा और डाउनलोड किया जा सकता है। साइट को एनएचपीसी के वेबसाइट www.nhpcindia.com के ई-खरीद कॉर्नर एवं सीपीपी पोर्टल के माध्यम से भी देखा जा सकता है। कोई बोली लगाने वाले जो इस निविदा के लिए कोट करना चाहता है वह ई-टेंडर के लिए ऑनलाइन बोलीदाता पंजीकरण के बाद पूर्वोक्त पोर्टल से निविदा दस्तावेज डाउनलोड कर सकता है।
 
2. योग्य बोलीदाता:
 
2.1 बोली के लिए यह आमंत्रण खुला है:
a) बोलीदाता जो निगमित कानूनी इकाई हैं और कानूनी और वित्तीय रूप से स्वायत्त हैं और अपने संबंधित क्षेत्राधिकार के वाणिज्यिक कानून के तहत काम करते हैं ।
b) क्लॉज 3 में परिभाषित योग्यता मानदंडों को पूरा करने वाले सभी बोलीदाता ।
c) Bidder shall be Class-I Local Supplier under Public Procurement (Preference to Make in India), Order-2017 issued by the Department of Promotion of Industry and Internal Trade (DPIIT), Ministry of Commerce and Industry vide No. P-45021/2/2017-PP (BE-II) dated 16.09.2020 or as amended from time to time. Bidders shall submit undertaking/self-certificate regarding Local content in the format provided. Bidder shall also give details of the location(s) at which the local value addition is made.
 
Public Procurement (Preferences to Make in India) Policy (including its latest modifications/amendments) as may be prevailing on the date of Price Bid Opening shall be applicable against this tender. Bidders are requested to go through the Public Procurement (Preferences to Make in India) policy available on concerned ministry website.
 
d) Bidder shall comply with the provisions of “Restrictions under Rule 144(xi) of the General Financial Rules (GFRs) 2017” issued by Department of Expenditure, Ministry of Finance dated 23.07.2020 and subsequent amendments.
 
2.2 Bidders shall not be under declaration of ineligibility for banning/delisting/blacklisting/ debarment from business on the ground mentioned in para 6 of Guidelines on Banning of Business dealings (Annexure-A) to Integrity Pact at the time of submitting the bid and shall intimate immediately of any such banning/delisting/blacklisting/debarring after submission of bid till award of tender. Self-Declaration in this regard is to be submitted as per the enclosed proforma (Form-6, Section-III).
 
2.3 जिन बोलीदाताओं का अनुबंध नियोक्ता द्वारा खराब प्रदर्शन के कारण समाप्त कर दिया गया है, उन्हें समाप्ति की अधिसूचना की तारीख से अगले 5 वर्षों तक बोली प्रक्रिया में भाग लेने की अनुमति नहीं दी जाएगी ।
 
2.4  निविदा प्रक्रिया में पारदर्शिता और निष्पक्षता में सुधार के लिए नियोक्ता सत्यनिष्ठा संधि को लागू कर रहा है ।
 
The Integrity Pact, signed by all the prospective Bidders and the Employer, shall commit the persons/officials of both the parties, not to exercise any corrupt/ fraudulent/collusive/coercive practices in the Tendering process and also during implementation of the Contract. Only those Bidders who have entered into Integrity Pact with the Employer shall be eligible to participate in the bidding process.
          All Applicants shall enter into an Integrity Pact (to be executed on plain paper) with the Employer at the time of submission of their Bids. The Integrity Pact digitally signed / signed on behalf of the Employer shall be as per Form-7 Section-III. The Integrity Pact shall be downloaded, printed and signed by the Applicant and to be submitted online.
 
सफल बोलीदाता (ठेकेदार) को पुरस्कार की अधिसूचना पर हस्ताक्षर करने से पहले उचित मूल्य के गैर-न्यायिक स्टांप पेपर पर
विधिवत निष्पादित सत्यनिष्ठा संधि प्रस्तुत करना होगा।
 
To oversee the compliance of obligation under the Integrity Pact,--------- (name of IEM ) has been appointed as Independent External Monitor (IEM) by the Employer. The Contact address of IEM is as under:
  
 
3.0 बोलीदाता की योग्यता
3.1           सभी बोलीदाताओं को अपनी बोली के साथ योग्यता संबंधी जानकारी में निम्नलिखित जानकारी और दस्तावेज शामिल करने होंगे, जब तक कि आईटीबी में न कहा गया हो:
 a) संविधान या कानूनी स्थिति, पंजीकरण का स्थान, और व्यवसाय की प्रमुख जगह को परिभाषित करने वाले मूल दस्तावेजों की प्रतियां; बोलीदाता को प्रतिबद्ध करने के लिए बोली के हस्ताक्षरकर्ता की लिखित पावर ऑफ अटॉर्नी। अनुभाग-III के फॉर्म -1 सामान्य जानकारी, में मांगी गई अतिरिक्त जानकारी प्रदान की जानी है ।
 b)   क्लाज 3.2 ए (बी) में निर्धारित मापदंडों को पूरा करने के लिए कार्य अनुभव अनुभाग-III के फॉर्म-3 काम के अनुभवों के रिकॉर्ड, में प्रदान किया जाना है। दिखाए गए कार्य अनुभव संबंधित कार्य के प्रभारी अभियंता/परियोजना प्रमुख द्वारा जारी आपूर्ति आदेश/कार्य आदेश/पुरस्कार पत्र की नोटरीकृत प्रतियों के साथ समर्थित किया जाना चाहिए। ठेकेदारों द्वारा निजी संगठनों के लिए किए गए कार्यों को निष्पादित करने के लिए अनुभव प्रमाण पत्र के मामले में, अनुभव प्रमाण पत्र के साथ टीडीएस प्रमाण पत्र भी प्रस्तुत किया जाएगा।
 c)    क्लॉज 3.2 ए (ए) में निर्धारित वित्तीय मानदंडों के बारे में जानकारी खंड-III के फॉर्म-4 वार्षिक कंसट्रकशन टर्नओवर में प्रस्तुत की जानी है। Copy of affidavit/Certificate of CA mentioning Annual Construction Turnover of last 3 (three) years. पिछले 3 (तीन) वर्षों के वित्तीय कारोबार की उल्लेखनीय शपथपत्र/ सीए के प्रमाण पत्र की छायाप्रति। मुद्रित वार्षिक रिपोर्ट या बोलीदाता के वित्तीय बयान, जेसे बैलेंस शीट, लाभ और हानि बयान और लेखा परीक्षक के रिपोर्ट के रूप में प्रस्तुत किया जाना है, जिससे बोली लगाने वाले की पिछले तीन साल के वित्तीय मानदंडों का पता लगाया जा सकता है।
 d)    प्रस्तावित कार्यप्रणाली (अनुसूची-जी अलग-अलग शीट में) और निर्माण कार्यक्रम (अनुसूची-ई में), उपकरण नियोजन और तैनाती (अनुसूची- F) में समर्थित, व्यापक रूप से व्यापक गणना के साथ समर्थित, निष्पादन और पूरा होने की उनकी क्षमता को न्यायोचित करता है तकनीकी विनिर्देशों के अनुसार और पूरा होने की निर्धारित अवधि के भीतर
 
 
 
3.2 A    To qualify for award of the Contract, each bidder should have:
a) Achieved in any one year in last three years a minimum Annual construction turnover of at least equivalent to the estimated cost of works for which bid has been invited.
 

1. Satisfactorily completed, in last 07 (seven) years ending on last day of month previous to one in which applications are invited, at least

 

1. 01 (one) similar work costing not less than the amount equal to 80% of the estimated cost of work
2.  
3. 02 (two) similar works costing not less than the amount equal to 50% of estimated cost of work
   •  
4. 03 (three) similar works not less than the amount equal to 40% of the estimated cost of works.

 
For arriving at the cost of similar work, the value of work executed shall be brought to current costing level by enhancing the actual value of work at simple rate of 7 (seven) percent per annum, calculated from the date of completion to the date of bid opening.
Similar nature of work means “Any Civil Works”
 
The similarity of work shall be pre-defined based on the physical size, complexity, methods/ technology and/ or other characteristics described, and scope of works.
 
3.2 B    Each bidder must also submit with their Bid:
i)  Copies of PAN, GST Registration No., EPF Registration No. and ESIC Registration No. (as applicable).
ii) A declaration that the information furnished with the bid documents is correct in all respects in form-5, form of declaration, Section-III.
iii) Such other certificates if any as defined in the ITB.
 
3.2 C    To qualify for Contract for which bids are invited in the Notice Inviting Tender, the bidder must demonstrate having work experience, financial capability and resources sufficient to meet the aggregate of the qualifying criteria. Failure to produce the certificates and documents in clauses 3.1 and 3.2(A) & (B) shall make the bid non-responsive.
 
3.2 D   JVs or any other arrangement other than sole bidder is not allowed.  Experience and resources of proposed sub-contractor, if any shall not be taken into account in determining the bidder’s compliance with the qualifying criteria. However, experience of bidder as sub-contractor approved by Project developer shall be considered. Experience of bidders as member of Consortium/Joint Venture shall be considered as per distribution of work against the member of the Consortium/Joint Venture. In case where distribution of Consortium/JV members is not specified in Consortium/JV agreement then the experience credential shall be considered for all members of JV with minimum 35% participation share.
 
3.2 E   All Startups (whether MSEs or otherwise) registered for similar nature of work falling within the definition as per Gazette notification- GSR 127(E) dated 19.02.2019 or as amended from time to time are exempted from meeting the qualification criteria in respect of Prior Experience-Prior Turnover as per para 3.2 A subject to their meeting the quality and technical specification. However, the Employer reserves the right to deny such exemptions to Startups in case of circumstances like procurement of items related to public safety, health, critical security operations and equipments, etc. 
 
3.2 F    Insolvency
                The Bidder against whom an application for initiating corporate insolvency resolution process has been admitted by the Adjudicating Authority under the Insolvency and Bankruptcy code 2016 or as amended from time to time shall not be eligible for bidding. The same shall also be applicable to the bidder company who has taken unconditional technical and/or financial support from their Parent/ Holding Company, against whom an application for initiating corporate insolvency resolution process has been admitted by the Adjudicating Authority under the Insolvency and Bankruptcy Code 2016, or as amended from time to time (IBC 2016 hereafter).
            In case, bidder in respect of whom any application for initiating corporate insolvency resolution process was not admitted at the time of submission of bid but subsequently during the period of evaluation of bids or any time before the work is awarded, any such application is admitted by the Adjudicating Authority under the IBC 2016, the bidder shall be considered as ineligible and his bid shall be rejected.
            An undertaking that “no insolvency proceedings is admitted by the Adjudicating Authority against bidder under the IBC 2016” shall be submitted on letter head duly signed by the authorized representative of bidder.
            Further, the bidder after submitting the bid till the time of award of work, shall inform NHPC regarding any admission of application for corporate insolvency resolution process by the Adjudicating Authority under the IBC 2016 against bidder and any suppression of such fact shall render the bidder liable for rejection of his bid and banning of business dealing as per terms and conditions of the Bid Document.
 
3.3       Disqualification:
 
Even though the bidders meet the above qualifying criteria, they are subject to be disqualified if they have:

1. made misleading or false representations in the forms, statements, affidavits, declarations and attachments submitted in proof of the qualification requirements; and/or,
2. participated in the previous bidding for the same work & found L-1 and had quoted abnormally high or low bid prices and could not furnish rational justification for it to the Employer,
3. The Bidders whose contract(s) have been terminated due to unsatisfactory performance by employer in past, shall not be allowed to participate in the bidding process till completion of the ineligibility period. In such case the bid shall be considered as non-responsive.

 
Note: - qualification criteria given above is illustrative and can be modified/adapted with proper reasons and justification to suit specific needs of the Project by Head of the Project/Region in case of award falling in the competence of Project and Head of the Region in case of award falling in the competence of Region ED.
 
4.0       कार्य पूर्ण होने का सामय:
सफल बोलीदाता क्रमांक-I में वर्णित निर्दिष्ट समय के भीतर पूरे कार्य को पूरा करेगा जिसकी गणना स्वीकृति पत्र जारी होने की तारीख से माना जाएगा ।
 
5.0       निविदाओं के साथ टेबल में कार्य के लिए निर्दिष्ट राशि की बयाना राशि संलग्न की जानी चाहिए।
 
6.0 पूर्व बैठक
a)सभी संभावित बोलीदाताओं के लिए बोली-पूर्व बैठक क्रमांक 1 के अनुसार स्थान, तिथि और समय पर आयोजित की जाएगी, जिसमें उन्हें कार्य और बोली शर्तों के संबंध में स्पष्टीकरण, यदि कोई हो तो, प्राप्त करने का अवसर दिया जाएगा।
b)संभावित बोलीदाता(ओं) अपने प्रश्न, यदि कोई हों, पूर्व-बोली बैठक से कम से कम 03 दिन पहले पैरा-8 में दिए गए पते पर ईमेल / कूरियर / फैक्स द्वारा प्रस्तुत कर सकते हैं ताकि बैठक के दौरान उसका उत्तर दिया जा सके।)
 

1.        Bid submission

i) Online Bid Submission – Technical Bid (Cover-I) (Refer Section-II i.e. ITB) and Price Bid (Cover-II) electronic format) complete in all respect must be uploaded at the aforesaid portal before the specified date & time as per SI. No. 1.
ii) Offline Bid Submission (Refer Section-II i.e ITB) complete in all respect must be delivered in sealed envelopes to the address, up to the specified date & time as per SI. No. 1
In the event of the specified date or amendment if any for the submission of bids being declared a holiday for the Employer, the hard copy of the documents will be received up to the specified time on the next working day. Similarly, in the event of the specified date or amendment if any for the opening of bids being declared a holiday for the Employer, the opening shall be carried out at the specified time on the next working day. However, the date and time for online submission of the Bids shall continue to be the date and time specified or amendment if any.
 

1.        The currency for the Bid shall be Indian Rupee only.

 

1.        Bids shall be valid for a period as mentioned in Sl. no. 1 after the deadline for Bid submission. If any Bidder withdraws his Bid before the said period or makes any modification in his Bid, the Earnest Money deposit of the Bidder shall be forfeited. Prior to the expiry of bid validity period, Employer may request Bidders to extend the Bid validity period. The request and the response shall be made in writing. An extension of the bid validity period will not entitle a Bidder to modify its Bid. In case Bidder fails to extend the bid validity upon employer’s request, the corresponding Bid shall be rejected as being non-responsive.

 

1.      The Techno-commercial Bid shall be opened online at venue date & time as per Sl. No.-1. the time and date of opening of Financial Bid of bidders qualified the technical bid shall be communicated through portal at later date after evaluations of technical bids. The Employer/Tender inviting Authority at his discretion may open Technical and Financial Bid simultaneously and evaluate the Bid completely.

 
11.0     The Employer may impose certain restrictions on the foreign companies participating in any form and their employees in view of the National Security, in the Project situated in the sensitive region and border areas. The Employer shall obtain clearance of Govt. of India regarding security implications prior to qualification of such company. Further, bidders from countries which share land border with India shall comply with Department of Expenditure, Ministry of Finance, GoI, OM No. F.No. 6/18/2019/PPD dt.23.07.2020 & 24.07.2020.
 
12.0         किसी भी शुद्धिपत्र बाद में संशोधन और/या बोली जमा करने की तिथि का विस्तार, यदि कोई हो, पोर्टल   http://eprocure.gov.in /eprocure/app. पर पोस्ट किया जाएगा। बोलीदाताओं को सलाह दी जाती है कि वे बोलि जमा करने की समय सीमा से पहले नियमित रूप से पोर्टल पर जाएँ ।.
 
 
13.0         नियोक्ता किसी भी बोली को स्वीकार या अस्वीकार करने और बोली प्रक्रिया को रद्द करने और सभी बोलियों को अस्वीकार करने का अधिकार सुरक्षित रखता  है,अनुबांध के पुरस्कार से पहले किसी भी समय, प्रभावित बोलीदाता या बोलीदाता(औं) के लिए कोई दायित्व वहन किए बिना । तथापि, जो बलिदाता रद्द/अस्वीकृति   के ऐसे निर्णय के कारणों की तलाश करना चाहते  हैं, उन्हें नियोक्ता द्वारा इसकी सूचना दी जाएगी, जब तक कि इसके प्रकटीकरण से भारत की संप्रभुता और अखंडता, सुरक्षा,रणनीतिक, वैज्ञानिक या  राज्य का आर्थिक हित या किसी अपराध के लीए उकसाना
 
14.0    'निविदा आमंत्रण सूचना' के अंग्रेजी और हिंदी संस्करण के शब्दों के बीच किसी भी अंतर के मामले में, अंग्रेजी संस्करण मान्य होगा ।
