General Terms and Conditions / Eligibility  
1). Form of Contract is L.S and turn Key Basis. 2). The Contractors applying for Tender Schedules should enclose attested copies of Proof of GST Registration Certificate incorporating his / their Identification Number 3) Balance 1 � % EMD if required is to be paid in the form of DD at the time of concluding the agreement. 4).The Executive Engineer reserves the right to reject any one or all the tenders without assigning any reasons thereof. 5).Other Terms and conditions can be had on request from this office hours. 6).Payment will be made only after receipt of L.O.C from the Government. 7).It is mandatory to verify the feasibility of the work with concerned AE/DEE/EE/User department. 8)The renderer who submitted bid online must submit the bid processing fee DD on or before opening date as mentioned (5.00 pm) to the bid inviting authority failing which the bid will be considered as NON RESPONSIVE 9) REFER TENDER CONDITIONS / CONTACT OFFICE OF THE TENDER INVITING AUTHORITY

General Technical Terms and Conditions (Procedure)  
1.Each tenderer should fulfil the following requirements, failing which, the tender will be treated as incomplete and will be rejected. (All the following particulars from sl.no.1 to 12 should be uploaded while submitting the bid online) 2.Declaration on tender conditions (Statement I). 3.Class IV and above Registration Certificate. 4.Online payment of transaction Fee to be paid to Managing Director, Andhra Pradesh Technology Services, Vijayawada through Electronic Gateway. 5.A crossed Demand Draft towards processing fee (non-refundable) 6.A crossed Demand Draft towards EMD/ PAY EMD AS MENSINED THROUGH ONLINE 7.Permanent Account Number (PAN) card. 8.Copy of GST (Card) Registration 9.Income Tax Returned (ITR) Form Latest should be submitted 10.All the Demand Drafts should be drawn as asked for from any one of the Bank (Approved List of Banks is available in the tender document / Notice board of Division Office) 11.No relaxation will be given to any of the qualification criteria as mentioned above. 12.Every bidder who submitted bid online must submit the DD towards processing fee (non refundable) to the tender inviting authority during office working hours on or before pre-working day of date of opening of bid and obtain proper acknowledgement failing which the bid will be considered as non responsive and necessary action will be initiated such as debarring from tendering of further works of the division office for a minimum period of 1 year.

Legal Terms & Conditions  
1.1 In interpreting these Conditions of Contract, singular also means plural, male also means female, and vice-versa. Headings have no significance. Works have their normal meaning under the language of the contract unless specifically defined. The Engineers-in-charge will provide instructions clarifying queries about the conditions of Contract. 1.2 The documents forming the Contract shall be interpreted in the following order of priority: 1) Agreement 2) Letter of Acceptance, notice to proceed with the works 3) Contractor?s Tender (Technical bid) 4) Conditions of contract 5) Specifications 6) Drawings 7) Bill of quantities (Price-bid) 8) Any other document listed as forming part of the Contract. 2. Managing Director?s Decisions: 2.1 Except where otherwise specifically stated, the Managing Director or his nominee will decide the contractual matters between the Corporation and the Contractor in the role representing the Corporation. 3. Delegation: 3.1 The Managing director may delegate any of his duties and responsibilities to other officers and may cancel any delegation by an official order issued. 4. Communications: 4.1 Communications between parties, which are referred to in the conditions, are effective only when in writing. A notice shall be effective only when it is delivered (in terms of Indian Contract Act) 5. (Sub-contracting) Subletting works by contractors: 5.1 If the prime contractor desires to sub-let a part of the work, he should submit the same at the time of filing tenders itself or during execution, giving the name of the proposed Sub-contractor, along with details of his qualification and experience. The Tender Accepting Authority should verify the experience of the Sub-contractor and if the Sub-contractor satisfies the qualification criteria in proportion to the value of work proposed to be sub-let, he may permit the same. The total value of works to be awarded on sub-letting shall not exceed 50% of contract value. The extent of subletting shall be added to the experience of the sub-contractor and to that extent deducted from that of the main contractor. 5.2 The subletting of works without prior written approval of the Tender Accepting Authority is strictly prohibited. In the event, it is found that any portion of the work is sublet without prior written approval of the Tender Accepting Authority, action will be taken against the contractor by debarring him from participating in the tenders for the period as decided by the Engineer-in-Chief / Chief Engineer. 6. Other Contractors: 6.1 The Contractor shall cooperate and share the Site with other contractors, Public authorities, utilities, and the Corporation. The Contractor shall also provide facilities and services for them as directed by the Engineer-in-charge. 7. Personnel: 7.1 The Contractor shall employ the required Key Personnel named in the Schedule of Key Personnel to carry out the functions stated in the Schedule or other personnel approved by the Engineer-in-charge. The Engineer-in-charge will approve any proposed replacement of Key Personnel only if their qualifications, abilities, and relevant experience are substantially equal to or better than those of the personnel listed in the Schedule.
