General Terms and Conditions / Eligibility  
To qualify for the consideration of award of the Contract, each tenderer should fulfill the following criteria. I) Eligible Class of Contractor: As per G.O. Ms.No. 178, date: 27-09-1997 or Class V as per G.O. Ms. No. 94 dated: 01-07-2003 equivalent registration with State Government. VLCCS and LCCS societies are not eligible as per G.O.Rt.No.52 Dt : 18.03.2000. The eligible intending bidders would be required to enroll themselves on the e-Procurement Market Place www.eprocurement.gov.in and submit their bids online II)The bidders can apply individually only. III) Joint ventures are not considered. IV) The bid of the lowest eligible tenderer will be considered only if the Demand drafts and original up loaded documents are submitted to Executive Engineer, RWS &S, Kadapa in person or through Registered post/ courier else necessary action will be initiated. The tender inviting authority does not take up any responsibility for delay in submission/non-submission of documents sent by Registered post/ courier, in time. V) The tenderer is subject to be disqualified, if he is found to have misled or furnish false information in the forms/statements/certificates submitted in proof of qualification requirements or record of performance such as abandoning of work not properly completed in earlier contracts, inordinate delays in completion of the works, litigation history and or Financial failures and or participated in the previous tendering for the same work and has quoted unreasonable high bid price. VI) The bidder shall authenticate the bid with his digital certificate for submitting the bid electronically on e-Procurement platform and the bids not authenticated by digital certificate of the bidder will not be accepted on the e procurement platform The bidder shall submit his response through Bid submission to the tender on apeProcurement platform at www.apeprocurement.gov.in by following the Processor The bidder would be required to register on the e-procurement market place www.apeprocurement.gov.in or https://tender.apeprocurement.gov.in and submit their bids online. Offline bids shall not be entertained by the Tender Inviting Authority for the tenders published in apeprocurement platform. The bidders shall submit their eligibility and qualification details, Technical bid, Financial bid etc., in the online standard formats displayed in apeProcurement web site. The bidders shall upload the scanned copies of all the relevant certificates, documents etc., in support of their eligibility criteria/technical bids and other certificate/documents in the apeProcurement web site. The bidder shall sign on the statements, documents, certificates, uploaded by him, owning responsibility for their correctness/authenticity. The bidder shall attach all the required documents for the specific tender after uploading the same during the bid submission as per the tender notice and bid document. 1. General Technical Terms and Conditions (Procedure)  
1. Bids are invited on the e-Procurement platform for the above-mentioned work from the contractors / contracting firms eligible as per clause 7 of this NIT, registered with Government of A.P. 2. App ECV: - As per NIT 3. E.M.D: As per NIT 4. Period of Completion of Work: As per NIT 5. Tender Schedules: Tender Schedules can be downloaded free of cost from the Web site www.e procurement.gov.in 6. Form of Contract: Lump sum contract. 7. Class of Contractor Eligible: Class-IV civil as per G.O.Ms.No.94, date: 01.07.2003 or equivalent registration with State Government. The eligible intending bidders would be required to enroll themselves on the e-Procurement Market Place www.eprocurement.gov.in and submit their bids online. 8. Availability of Tender Documents: As per NIT. 9. Bid Submission closing Date: As per NIT 10. Time and date of opening of Tenders: (a) Price / Financial Bid: As per NIT Note: The dates stipulated above are extendable by an official notification by the department or happen to be the Public Holidays. 11) The tenderer is subject to be disqualified, if he is found to have misled or furnished false information in the forms/statements / certificates submitted in proof of qualification requirements or record of performance such as abandoning of work not properly completed in earlier contracts, inordinate delays in completion of the works, litigation history and or Financial failures and or participated in the previous tendering for the same work and has quoted unreasonable high bid price. 12) Even while execution of the work, if found that the contractor had produced false/fake certificates of experience, he will be black listed and the contract will be terminated and his EMD will be forfeited. 13) TRANSACTION FEES: The Participating bidders shall pay transaction fee as shown in the NIT (including 12.36% Service tax). All tenderers have to pay the above non refundable transaction fee in the form of online receipt of ICICI / HDFC online receipt payable to M/s Vupadhi Techno Services Pvt. Ltd, Hyderabad and it shall be from a Nationalized/Scheduled Bank. 14) I) Any other condition regarding receipt of tenders in conventional method appearing in the tender documents may please be treated as not applicable. II) All documents furnished in support of eligibility for tender , should be attested by the tenderer. The tenderer need not upload tender schedule Volume I, Volume II in e-procurement, but they have to furnish the certificates in e-procurement stating that I have gone through all tender conditions and accepted them without any pre conditions. Here all tender conditions mean including amendments, if any. Non submission of these certificates will liable to rejection. III) The successful bidder shall pay an amount equivalent to 0.04% of ECV (estimated contract value) with a cap of Rs. 10,000 (Rupees ten thousand only) for all works with ECV upto Rs. 50 Crores on eProcurement platform before entering into agreement/issue of purchase orders, towards eprocurement fund in favour of Managing Director, APTS, Hyderabad through the Agreement authority. Digital Certificate authentication: The bidder shall authenticate the bid with his Digital Certificate for submitting the bid electronically on apeProcurement platform and the bids not authenticated by digital certificate of the bidder will not be accepted on the apeProcurement platform. Legal Terms & Conditions  
Hard copies: i) Vide ref. G.O.Ms.No.174, I&CAD dept dated:1-9-2008, submission of original hard copies of the uploaded scanned copies of Online Paymet towards EMD by participating bidders to the tender inviting authority before the opening of the price bid is dispensed forthwith. ii) All the bidders shall invariably upload the scanned copies of Online Payment in apeProcurement system and this will be the primary requirement to consider the bid responsive. iii) The department shall carry out the technical evaluation solely based on the uploaded certificates/documents, Online Payment towards EMD in the apeProcurement system and open the price bids of the responsive bidders. iv) The department will notify the successful bidder for submission of original hardcopies of all the uploaded documents Online Payment towards EMD prior to entering into agreement. v) The successful bidder shall invariably furnish the original Online payment towards EMD, Certificates/Documents of the uploaded scan copies to the Tender Inviting Authority before entering into agreement, either personally or through courier or post and the receipt of the same within the stipulated date shall be the responsibility of the successful bidder. The department will not take any responsibility for any delay in receipt/non-receipt of original Online Payment towards EMD, Certificates/Documents from the successful bidder before the stipulated time. On receipt of documents, the department shall ensure the genuinity of the Online Payment towards EMD and all other certificates/documents uploaded by the bidder in eProcurement system. In support of the qualification criteria before concluding the agreement. 4. The GO. Ms. No. 174 -I&CAD dated: 1-9-2008 Deactivation of Bidders If any successful bidder fails to submit the original hard copies of uploaded certificates/documents, Online Payment towards EMD within stipulated time or if any variation is noticed between the uploaded documents and the hardcopies submitted by the bidder, as the successful bidder will be suspended from participating in the tenders on eProcurement platform for a period of 3 years. The eProcurement system would deactivate the user ID of such defaulting bidder based on the trigger/recommendation by the Tender Inviting Authority in the system. Besides this, the department shall invoke all processes of law including criminal prosecution of such defaulting bidder as an act of extreme deterrence to avoid delays in the tender process for execution of the development schemes taken up by the government. Other conditions as per tender document are applicable. The bidder is requested to get a confirmed acknowledgement from the Tender Inviting Authority a proof of Hardcopies submission to avoid any discrepancy
