General Terms and Conditions / Eligibility  
Eligibility criterion Eligibility Conditions: To quality for consideration of award of the contact each tenderer should fulfill the following.. 1] The details and certificates are to be furnished as per the proforma available in tender schedules. 2] The bidder should submit the particulars invariably in the format specified in the tender schedule along with necessary certificates. Failing to which his tender shall be treated as incomplete and summarily rejected. 3] The tenderer should employ 1- Graduate Engineer (Civil) with adequate experience and one technical person with Diploma certificate is mandatory. the graduate Engineer should enclose B-Tech certificate along with appointment letter and Diploma engineer should enclose diploma certificate along with appointment letter. All the above certificates should be properly attested. 4) PAN card with both sides should be enclosed which is mandatory and certificate should be properly attested, EMD @ 1% on ECV through online payment 5) Latest Income Tax and GST certificates should be enclosed and certificates should be properly attested. 6) The Contractor registration should be eligible for panchayat raj Engineering Department.This is Mandatory and certificate should be properly attested. The service charges payable to M/s APTS Ltd., as laid down in the G.O.Ms.No.2 , Information and Communication Department, dt.15-01-2003 and other relevant G.O.s are as indicated below. Transaction fee : 0.03% of the Estimate Contract value of the work + 18% Service Tax on 0.03% of Estimate Contract Value The transaction fee is payable by all the serious bidders as per the GO MS NO 13 dt.5.07.06 NOTE :- a) The Successful bidder will pay further fee @ 0.04% of the Estimate Contract value of the work Payable to MD, APTS., Vijayawada. 3.1 The tenderer shall furnish the following particulars online and supported documentary evidence shall be uploaded. a) Attested copies of documents relating to the Registration of the firm, Registration as Civil Contractor, Partnership deed, Articles of Association, GST Registration, Latest SARAL (AY 2021-22) form submitted to IT department with PAN CARD, . Note: The Partnership firms, which are registered as Contractors shall intimate the change in partnership deed, if any, as per GO Ms No.58, I & CAD, dt.23.4.2002 within one month of such change. Failure to notify the change to the registration authority in time will entail the firms to forfeit their registration and their tender will be rejected. The intimation of change of partners if any and the acceptance by the Registration authority may be enclosed. b)availability of key personnel for administration / site management and execution viz., technical personnel required for the work. c) information regarding any litigation, with Government during the last five years, in which the Tenderer is involved. General Technical Terms and Conditions (Procedure)  
General Terms & Conditions:- 1) Even at the stage of execution of work, if found that the contractor had produced false / fake certificates or information, he will be black listed and the contract will be determined under clause 60 (a) of PS to APSS, (2) The participating bidders will have to pay transaction fee @ 0.04% of ECV (Estimated Contract value) with a cap of Rs.10,000/- (Rupees Ten thousand only) for all works with ECV upto Rs.50.00 crores and Rs.25,000/- (Rupees twenty five thousand only) for works with ECV above Rs.50.00 crores, at the time of bid submission. All the participants shall electronically pay the transaction fee to the service provider through "Payment Gateway Service on eprocurement platform".The Electronic Payment Gateway accepts all Master and Visa cards issued by any bank to facilitate the transaction. (3) The successful tenderer has to pay 0.04% of estimate contract value towards e-procurement corpus fund by the way of DD in favour of MD, APTS, Vijayawada and hand over the same to the Superintending Engineer, Panchayati Raj, Eluru, at the time of concluding agreement. (4)The tender inviting / receiving authority reserves the right to postpone / cancel / reject any or all the tenders without assigning any reason whatsoever, (5) the tenders received with more than 0% of the estimated rates shall be summarily rejected, (6) Negotiations are not permitted to be conducted at any level, (7) The defect liability for all the works will be 24 months duly taking into account normal wear and tear from the date of completion of total work, (8) If the Office happens to be closed on account of extraordinary holiday on the date of opening of the bids as specified, the bids will be opened on the next working day at the same time and venue, (9) the tender shall be valid for a period of 90 days from the last date for receipt of bid, (10) Price adjustment shall be allowed for Steel,Cement,Bitumen & POL in terms of G.O.Ms.No.94 dated 16.04.2008 of TR&B (R1) dept. subject to following conditions: i) Price Adjustment shall be both for increase and decrease in the prices for the works completed within original agreement period. ii) In addition, price adjustment shall be for valid extension given for natural calamalities duly limiting to the actual period/days lost and for portion of work where work is delayed due to land acquisition/shifting of utilities (this shall also be limited to actual length affected) (iii) The variation clause will be allowed when the variation in rates is more or less than 5% of the rates provided in the technically sanctioned estimate based on which bids are invited (or) All India Wholesale Price Index as stipulated in the G.O.Ms.No.35 dated 28.2.06 of TR &B(RI) dept. on the date twenty eight days prior to closing date of submission of bids, which ever is advantageous to the department. 11) Any other details can be seen in the tender document. 12) The successful bidder shall invariably furnish the original BG towards EMD, Certificates/Documents of the uploaded scan copies to the Tender Inviting Authority before entering into agreement, either personally or through courier or post and the receipt of the same within the stipulated date shall be the responsibility of the successful bidder. The department will not take any responsibility for any delay in receipt/non-receipt of original BG towards EMD, Certificates/Documents from the successful bidder before the stipulated time. On receipt of documents, the department shall ensure the genuinity of the BG towards EMD and all other certificates/documents uploaded by the bidder in eProcurement system. In support of the qualification criteria before concluding the agreement. Attested copies of documents relating to the Registration of the firm, Registration as Civil Contractor, Partnership deed, Articles of Association, GST Registration, Latest SARAL (FY 2019- 20) form submitted to IT department with PAN CARD.

During continuance of the contract, the contractor and his sub contractors shall abide at all times by all existing labour enactments and rules made there under, regulations, notifications and bye laws of the State or Central Government or local authority and any other labour law (including rules), regulations, bye laws that may be passed or notifications that may be issued under any labour law in future either by the State or the Central Government or the local authority and also applicable labour regulations, health and sanitary arrangements for workmen, insurance and other benefits
