General Terms and Conditions / Eligibility  
A. Eligibility Criterion: The Contractors Registered as Class-IV and above Civil as per G.O.Ms.No.94,Dated:01.07.2003 and G.O.Ms.No.130 dated:22.05.2007. B. Availability of the key personnel Two Diploma Holder and One Graduate with adequate experience in Civil works. C. Copy of PAN card with a copy of latest income tax return i.e., 2023-24. D. Copy of GST Registration Certificate. E. Scanned copy of online receipt towards EMD @ 1% on ECV i.e, Rs.12630/- F. Scanned copy of Transaction fee Receipt for Rs.448/-. G. Detailed eligibility criteria are stipulated in the bid documents. The bids, which do not fulfill the eligibility criteria, will not be considered. H.Scanned copy of proof of payment of annual profession tax receipt for the previous year i.e,.2023-24 (As per instructions of the Govt vide Cir.Memo.No.ICD01- COOR/67/Reforms/2020-2 Dt.09.09.2021) I.Even though the tenderers meet the above qualifying criteria, they are liable to be disqualified/debarred/ suspended/blacklisted if they have ? Furnished false/fabricated particulars in the Forms, Statements and Annexures submitted in proof of the qualification requirements and/or ? Not turned up for entering into agreement, when called upon. ? record of poor progress such as abandoning the work, not properly completing the contract, inordinate delays in completion, litigation history or financial failures etc. and/or ? participated in the previous bidding for the same work and had quoted unreasonably high tender percentage and ? even while execution of the work, if found that the work was awarded to the Contractor based on false / fake Certificates of experience, the Contractor will be blacklisted and work will be taken over invoking clause 61 of PS to APSS. NOTE: The bidders shall sign on all the statements, documents, certificates uploaded by him owning responsibility for their correctness/authenticity. 26. Procedure for Bid Submission: 1. The Bidder would be required to register on the e-procurement market place www.eprocurement.gov.in. and submit their bids online only. The department will not accept any bid submitted in the paper form. Bidders are requested to submit the bids in single stage i.e Technical Bid and price bid. 2. a. Detailed procedure for bid submission is described in the bid documents. b. For registration and online bid submission bidders may contact HELP DESK of M/s.Vupadhi Technologies Pvt Ltd, in www.apeprocurement.gov.in & https://tender.apeprocurement.gov.in. as per G.O.Ms.No.174, Dated:1.9.2008 of Irrigation & CAD Department. i. All the bidders shall invariably upload the scanned copies of Online receipt towards EMD in the e-procurement system. ii. The Department shall carryout the Technical bid evaluation solely based on uploaded certificates/documents, Online receipt towards EMD in e-procurement system and open the price bids of the respective bidders. iii. The Department will notify the successful bidder for submission of original hard copies of all uploaded documents, Online receipt towards EMD prior to entering into agreement. Note: 1. The bids, which do not fulfill the eligibility criteria, will not be considered. 2. General Terms & Conditions: To qualify for consideration of award of Each Tender should fulfill the following criteria. 1. The details and certificates are to be furnished as per the proforma available in the tender schedules. 2. The tenderer should have the key and critical equipment (either owned or leased as mentioned in the tender documents) 3. The bidder is subjected to be disqualified and liable for black listing and forfeiture of EMD, if he is found to have misled or furnished false information in the Forms/ Statements/ Certificates submitted in proof of qualification requirements. 4. Even while execution of the work, if it is found that the contractor had produced false/fake certificates of experience he will be liable for black listing and the contract will be liable for termination and liable for forfeiture of EMD and all the amounts due to him. 5. Bidders shall submit a declaration without any reason what so ever that the submitted eligibility and qualification details, techno-commercial bid and financial bid are without any deviations and are strictly inconformity with the documents issued by the employer. 6. Declaration should be given for the correctness of the credentials submitted by the bidder. 7. The employer reserves the right to relax the conditions and required for eligibility of the bidders in the public interest. The Bidder(s) shall not have any right to question the decision taken by the employer in this regard. 8. The bidder(s) shall submit a written power of attorney authorizing the signatory of the bid to commit for the bidder. Special Conditions: 1. Issue of Bid Documents will not automatically construe the eligibility of the bidder(s) for participation in the subsequent bidding process and eligibility will be determined during evaluation. 2. The Executive Engineer, PBC Division Pulivendula, Andhra Pradesh reserves the right to accept or reject any or all the bids without assigning any reason whatsoever. 3. The dates stipulated in the NIT are firm and under no circumstances they will be relaxed unless officially notified. 4. The bidder(s) shall submit their tenders online only. Any sort of difficulties in the internet, web site, in submission of tender, the department is not responsible. 5. Tenders shall be valid for a period of 1 Month from the date of submission of bids. Before expiry of validity, the tender inviting authority may seek further extension of validity of the bid from the bidder and in case, the validity is not extended, the bid will not be considered after such expiry. 6. In case of discrepancy, quoted online and in supporting documents uploaded then the price quoted in the template provided online only would be considered for evaluation. 7. The EMD will be refunded to the unsuccessful bidder(s) either after finalization of tender or on expiry of validity of period of tenders whichever is earlier. 8. Tenders with an excess of more than 5% over the ECV Value arrived by the department shall be summarily rejected. 9. In respect of tenders beyond 25% less than ECV Value arrived by the department, a Bank Guarantee or Demand Draft for the difference between the tendered amount and 75% of ECV Value should be furnished at the time of agreement as additional security Deposit. 10. In the process, if the works are stalled due to legal intervention or due to natural calamities, no compensation will be paid. 11. The Govt. reserves the right to cancel / alter the bid conditions at any time. 12. Other conditions are as per the bid documents which will be available on e-Procurement Market Platform from 02.09.2024, 17:00hours onwards (online only). 13. The e-procurement application is PKI enabled and supports the digital certificates issued by APTS, for signing the bids at the time of submission by contractor. The contractor has to procure digital certificates issued by APTS Ltd., Hyderabad as per the procedure. Digitally signed bids are to be submitted electronically through e-procurement, without which the tender will not be considered for opening the price bid. 14. The bidders who intend to know the procedure of bid submission on e-procurement platform; suitable training will be given by M/s.Vupadhi Technologies Pvt Ltd., Hyderabad. 15. The bidder should submit a copy of valid GST Registration certificate issued by the GST Registration authority. 16. The EMD @ 1% on Contract Value shall be collected, in the form of B.G./D.D. from the successful bidder at the time of concluding the agreement, instead of the prevailing 2.5% of contract value.(as per G.O.Rt.No.266,Dt15.02.2021.) 17. The transaction fee of Rs.448/- has to be paid through Electronic Gateway Payment System to A.P.T.S., Vijayawada by each participating bidder at the time of Bid Submission itself. 18. National Academy Construction: The Bid price quoted by the Contractor is exclusive of NAC and shall be recovered at the rate 0.1% on the cost of construction in each bill of the contractor and reimbursed within provisions made in the Schedule-A, Part II. 19. Goods and Service Tax (GST) Component: The GST component of 18% provided in Schedule-A, Part-II of Agreement. The GST at the rate of 18% will be added work done of each bill of the contractor and the same will be recovered and as per Government rules varies from time to time. 20. Seigniorage charges: The estimate Unit Rates of various items are exclusive of Seigniorage charges. A lump sum provision of Seigniorage charges is provided in Part-II of Schedule-A as per G.O. Ms. No.83, Water Resources (Reforms) Department, Dated:5.8.2015. The Seigniorage charges rates will be effected for the material used on the work vide G.O.Ms.No.100, Industries and Commerce (M.I) Department, Dated:31.10.2015or as modified by the Government from time to time are recovered on all materials and ordinary earth used in the work from the bills on the quantities measured. The Seigniorage charges recovered from the Agency will be reimbursed after providing of evidence of payment of Seigniorage charges. 21. Income Tax: During the currency of the contract deduction of income tax at Prevailing rate shall be made from the gross value of each bill of the contract as per Income tax Act, 1961 shall be followed. The Income tax will be recovered from gross value of the work bill of contractor as amended by the Government from time to time. 22. The successful bidder has to pay e-procurement corpus fund @ 0.04% on ECV through online in favour of APTS, Vijayawada at the time of concluding Agreement. (As per G.O.MS.No.4,Dt.17.02.2005 user department shall collect 0.04% on ECV with a cap of Rs.10000/- for all works with ECV up to Rs.50.00 crores and Rs.25000/- for works with ECV above Rs.50.00 crores from successful bidders on ?e? procurement platform before entering in to agreement/issue of purchase orders, towards ?e? procurement fund in favour of Managing Director,APTS.There shall not be any charge towards ?e?procurement fund in case of works,goods and services with ECV less than and up to Rs.10.00 lakhs)

General Technical Terms and Conditions (Procedure)  
3.0 PAYMENT OF E.M.D. 3.1 Each tenderer must pay along with tender at the time of uploading the tenders at the rate of one percent of estimated contract value that is sum of Rs.1262915 /- (Rupees Twel Lakhs sixty two thousand nine hundred and fifteen only) to be paid by using Net-Banking for RTGS/NEFT from there registered bank accounts from any Government owned Public Sector Bank or any Scheduled Commercial Bank. Xerox copy of the online payment receipt towards EMD is to be scanned and uploaded along with the Bid. 3.1 The successful bidder shall invariably furnish the original certificates/documents of the uploaded scanned copies to the Tender Inviting Authority before entering into agreement either personally or through courier or post and the receipt of the same within the stipulated date shall be the responsibility of the successful bidder. The Department will not take any responsibility for any delay in receipt/non-receipt of original certificates/documents, from the successful bidder before the stipulated time. If any successful bidder fails to submit the original Hard Copies of uploaded certificates/Documents, Online payment receipt towards EMD within the stipulated time or if any variation is noticed between the uploaded documents and the hard copies submitted by the bidder, the successful bidder will be suspended from participating in the tenders on e-Procurement platform for a period of 3 years. The e-Procurement system would deactivate the user ID of such defaulting successful bidder based on the trigger/recommendation by the Tender Inviting Authority in the system. Besides this, the Department shall invoke all processes of law including criminal prosecution of such defaulting bidder as an act of extreme deterrence to avoid delays in the tender process for execution of the development schemes taken up by the Government. 3.2 The successful tenderer should however pay balance E.M.D. i.e., the E.M.D. calculated at (two and half) 2.5% of the E.C.V. less the E.M.D. paid along with the tender at the time of filing tender for the work costing more than Rs. 10.00 Lakhs at the time of concluding the agreement in the shape of crossed Demand Draft in favour of the Executive Engineer, NTR TGP Division, No.1, Kadapa. 3.3. The Retention amount from the bills will be deducted at the rate of 7.5% as usual. 3.4. The Earnest Money deposit will be returned to the unsuccessful tenderer either after the finalization of the tenders or on expiry of validity of tender whichever is earlier. 3.5 The earnest Money deposit will be retained in the case of the successful tenderer and will not carry any interest, it will be dealt with, as provided in the tender. 3.6 The tenders received will be decided within a period of One months after the expiry of the last date prescribed for the receipt of the tenders and the decision regarding the disposal of the tenders will be informed at any time within the said period. The tender shall remain valid for a period of One months. 3.7 During the above mentioned period, no plea by the tenderer for any sort of modification of the tender based upon or arising out of any alleged misunderstanding or misconnection or mistake for any reason will be entertained. 3.8 All the earnest money deposited by the tenderer will be forfeited to the Government if the authority competent to accept the tender so desires in the event of such tenderer withdrawing his tender within the period of three months as specified above. 3.9 Tenders shall be valid for a period of 1 months. Before expiry of validity, the authority competent to call for tender shall seek for further extension of validity from the Contractors and in case the validity is not extended his tender will not be considered and the E.M.D. shall be returned. 3.10 In consideration of the Executive Engineer / Superintending Engineer / Chief Engineer / Commissionarate of Tenders, undertake to investigate and to take into account each tender and in consideration of the work thereby involved, all earnest money deposited by the tenderer will be forfeited to the Government in the event of such tenderer either modifying or withdrawing his tender at his instance within the said validity period of three months. 3.11 It is to be noticed that the system of availing concessions by depositing L.S. Deposit of Rs.3.00 Lakhs with the Chief Engineer is since withdrawn. Any previous deposits and concessions permitted by respective Chief Engineer will not be applicable to the present tender. 4.0 EVALUATION OF TENDERS The Executive Engineers and Superintending Engineers who are delegated with the powers to invite the tenders will open and evaluate the tenders as per the qualification criteria. 4.01 Before recommending / accepting the tender accepting authority shall verify the correctness of certificates submitted to meet the eligibility criteria. 4.02 The E.M.D. will be returned either after finalisation of tender or on expiry of validity of Tender which ever is earlier for the unsuccessful tenderer. FINALISATION OF TENDERS : 4.1.1 Tenders will be finalized by the Executive Engineers / Superintending Engineers / Chief Engineer / Engineer ?in- Chief (IW) on works costing upto their powers to accord technical sanction. The tenders for the works costing more than Rs.1000 Lakhs will be referred to Commissionarate of Tenders along with Technical Bid evaluation for consideration. The Commissioner of Tenders shall scrutinize the tenders submitted by Chief Engineer in accordance with the conditions stipulated in the Tender document and in case any discrepancy of non-adherence to the conditions, the same shall be communicated which will be binding both on the tender concluding authority and the Contractor. In case of any ambiguity, the decision taken by the C.O.T. on tenders shall be final. The C.O.T. will examine the bids and decides the successful bidders and communicate its decision to the Chief Engineer / Engineer-in-Chief (Irrigation). The Chief Engineer / Engineer-in-Chief (Irrigation) inturn communicates to the Commissionarate of Tenders decision to the Superintending Engineer. All this process will be online. 4.1.2 The Chief Engineer / Engineer-in-Chief (IW) shall finalise the tender for the works costing upto Rs.1000 Lakhs. 4.1.3 Negotiations are not permitted to be conducted at any level. 4.1.4 The time allowed from the date of publication of tender notice to the date of receipt of tenders is 14 days for the first call. 4.1.5 The permissible tender excess is 5% over the estimate contract value and in case the excess is more than 5% the tenders shall be summarily rejected and no negotiations will be conducted with the tenderer. At the same time, the tenders received with maximum permissible percentage excess are not necessarily to be accepted. Tenders upto 25% less than the estimated Contract values may be accepted but for tenders which are less by more than 25% of the estimate, a bank guarantee or demand draft for the difference between the tendered amount and 75% of the estimated value shall be taken so that if the tenderer leaves the works midway and the Department is forced to call for tenders for the work once again, the bank guarantee or demand draft should be used to finance the re-tendered work 4.1.6 The tenders received are found to have abnormally high percentage or within the permissible ceiling limits prescribed, but under collusion due to unethical practices adopted at the time of tendering process, shall be rejected. 4.1.7 Tender Premium : (i) Ceiling of Tender Premium : For all works, the ceiling of tender premium shall be 5%. As per the guidelines, even after two calls if the tender premium quoted is more than 5%, the matter should be referred to the Government and the Government may order for a fresh call or may constitute a Committee to award the work on nomination to a reputed Contractor from the list to be maintained by the Department on the basis of performance of Contractors. 5.0 When a tender is accepted, the successful tenderer shall attend the Office of the Executive Engineer, PBC Division, Pulivendula, on the date fixed by written intimation to him. He shall make payment of balance E.M.D. and sign an agreement in the proper departmental form for the due fulfillment of this contract. Failure to attend the Superintending Engineer?s Office on the date fixed in the written intimation from such office or to enter into the required agreement shall enable forfeiture of the Earnest Money. The written agreement to be entered into between the Contractor and the Government shall be the foundation of the rights and obligations for both the parties and the contract shall not be deemed to be complete until the agreement has first signed by the Contractor and then by Officer authorized to enter into contract on behalf of the Government. 5.1 The following L.S. Provisions as shown in Part-II of Schedule-A are made in the estimate. i) A Lumpsum provision of Rs.227908/-towards GST @ 18% on ECV. ii) Lumpsum provision of Rs.1265/- towards NAC @ 0.1% on ECV. iii) Provision towards Seignorage charges of Rs.1975 /- The tenders are eligible for reimbursement of above amounts, not exceeding the amounts indicated against each. 5.2 The successful tenderer has to sign an agreement within a period of 15 days from the date of receipt of communication of acceptance of his tender. On failure to do so, his tender will be Cancelled duly forfeiting E.M.D. paid by him without issuing any further notice. 6.0 The tenderer shall examine closely the A.P.S.S. also the Standard Preliminary Specifications contained therein and sign in the Superintending Engineer?s Office copy of the A.P.S.S. and its addenda volume in token of such study before submitting his tender unit rate which shall be for finished work in-situ. He shall also carefully study the drawings and additional specifications and all the documents which form part of the agreement to be entered into by the successful tenderer. The A.P.S.S. and other documents connected with contract such as specifications, plans, descriptive specifications sheet regarding materials etc., can be seen at any time between 11:00 A.M. to 5:00 P.M. on all working days in the Office of the Superintending Engineer. 6.1 A copy of the set of the Contract documents can be down loaded free of cost from the web site www.apeprocurement.gov.in by the Contractor enrolled with ?e? procurement platform. 7.0 The tenderer?s attention is directed to requirement for materials under the clause ?Materials and Workmanship? in the Preliminary Specifications. Materials confirming to the Indian Standards Specifications shall be used on the work and the tenderer shall quote his percentage accordingly. 7.1 The tenderer has to do testing of materials with his own equipment and satisfy himself that they confirm to the specifications of respective ISI codes before tendering. 7.2 The Contractor shall himself procure the required construction materials of approved quality including the earth for formation of embankment and water from quarries / sources of his choice. All such quarries / sources of materials required for the work shall be got approved by the Engineer-in-Charge in writing well before their use in the work. 7.3 The Contractor shall himself procure the steel, Cement, Hume Pipes, Bitumen, Blasting material, Sand, Metal, Soils etc., such other materials required for the work well in advance. The Contractor has to bear the cost of materials, conveyance and storage charges etc., The Department will not take any responsibility for fluctuations in market in cost of the materials, transportation and loss of materials etc., 7.4 A Schedule of quantities accompanies the tender notice, shall be definitely understood that the Government does not accept any responsibility for the correctness or completeness of this Schedule is liable to alterations by omissions, deductions or additions at the discretion of the Executive Engineer or as set forth in the conditions of the contract. The tenderer will however base his lumpsum tender on this Schedule of quantities. The Contract for such lumpsum quantities agreeing with the total amount of Schedule accompanying the lumpsum tender and shall be written legibly and be free from erasing, over writing or corrections of figures. Corrections where unavoidable should be made by crossing out, initialing and dating rewriting. 7.5 The Financial Bid accompanying the tender shall give the Schedule of quantities to be executed. It shall be understood that the Government does not accept any responsibility for the correctness or completeness of the Schedule and is liable to alterations by omissions, deductions or additions at the discretion of the Executive Engineer or as set forth in the condition of the Contract. The tenderer will however base his L.S. tender on his Schedule of quantities and rates. The tenderer should indicate his willingness to do the entire work at estimated contract value of the work or at a percentage less / more than the estimated contract value of the work as indicated in the Technical Bid. 8.0 INSPECTION OF SITE AND QUARIES BY THE TENDERER : Every tenderer is expected to inspect the site of proposed work before submitting his tender. He should also inspect the quarries and satisfy himself about the quality and availability of materials. The best class of materials to be obtained from quarries or other sources shall be used on the work. In every case, the materials must comply with the relevant standard specifications. Samples of materials as called for in the Standard Specifications or in this tender notice or as required by the Executive Engineer, in any case, shall be submitted for the Executive Engineer?s approval before the supply to site of work to begin. 9.0 The tenderers particular attention is drawn to the section and clauses in the Standard Specification dealing with. 1. Test inspection and rejection of defective materials and work. 2. Carriage. 3. Construction Plant. 4. Water and lighting. 5. Clearing up during the progress and for delivery. 6. Accidents. 7. Delays. 8. Particulars of payments. The Contractor should closely pursue all the specifications, clauses which govern the percentage he is tendering. 9.1 The defect liability period of Contractor in terms of Clause 28 of A.P.S.S. shall be 6 Months as it is a consultancy services for preparation of DPR and if any defects arises in the preparation of DPR and it connected works, the same may be rectified with you own cost, separate amount will not be paid. 10.0 The tenderer will not be required to quote item wise, rate / amount. He should indicate the willingness to execute the work either at the estimated value of the work or at a percentage in excess of the estimated value of the work or at a percentage less that the estimated value of the work. He would write his offer and percentage both in figures and words.

SPECIAL SPECIFICATIONS (S.S) SCOPE OF WORK The information and data furnished here is relevant to the work and site conditions are general. It shall be responsibility of contractor for fully acquaint himself with the nature and location of works , quarries local conditions and other aspects which are relevant to the work. (A) LOCATION OF THE WORK :- The scheme is located in Near Gurjala village, Simhadripuram Mandal of YSR District. (land acquisition funds) The work is taken up with State Funds and required to be completed as per mile stone. Land Acquisition is taken up. I) Details of work as each mile stone : (Finished items of work) As per Page No.23. Note : the information is the best available. However the department does not guarantee the correctness of interpretations deductions of conclusions which are given as supplementary information. The information have been produced as found communicated ascertained or otherwise learned by the department. 1.1 GENERAL SPECIFICATIONS: 1.1.1 a) These Technical specifications, shall apply to all works as are required to be executed under the contract or otherwise directed by the Engineer. In every case every the work shall be carried out to the satisfaction of the Engineer concerned and conform to the location, lines grades and cross-sections shown on the drawings or as indicated by the Engineer concerned. The quality of work and materials, shall comply with the requirements set-forth in this and succeeding sections. Where the drawings and specifications describe a portion of the work in only general terms, and not in complete detail, it shall be understood that only the best general practice is to prevail, materials and workmanship of the best quality are to be employed and the instructions of the Engineer concerned are to be fully complied with. b) The contractor shall carryout the works in accordance with the specifications laid down in this section together with the detailed specification stipulated under succeeding sections. Andhra Pradesh Standard Specifications, relevant codes with all amendments published upto the date of tendering and the departmental manual for quality control. 2.1.1 General : The data, pertaining to the work furnished in the relevant report and drawings, are for information of tenders the Govt. of Andhra Pradesh does not guarantee the Reliability or .accuracy of any the data and shall assume no responsibilities for any deductions, conclusions or interpretations that may be made from them. The contractor shall undertake at his expenses such studies as are necessary to assess the reliability and accuracy of the information presented in the data. 3.0 PERSONNEL OF THE CONTRACTOR: 3.1 The contractor shall at all times, maintain on the work a staff of qualified Engineers and Supervisors of sufficient experience of similar other jobs to ensure that the quality of work turned out shall be as intended in these specifications and they shall be present at the work-spot during working hours and at the time of inspection by the Departmental Officers. All orders and direction given to such supervisory or other staff of the contractor to be present on any specified inspection and the contractor shall comply with such requisitions. 3.2 The contractor shall supply to the Executive Engineer details of name, qualifications and experience in regard to all supervisory staff employed by the contractor and notify the changes when made and satisfy the Executive Engineer regarding the quality and adequacy of staff thus employed. 3.3 The Executive Engineer will have the unquestionable right to ask for change in the quantity and the number of the contractor's supervisory staff and to order removal from the work and connection herewith of any of such staff. The contractor shall comply with such order and effect replacement to the satisfaction of the Executive Engineer. 3.4 The contractor shall not without written authorization permit entry on site of work of any person authorised agents, engaged on hand in connection with work. 3.5 All vehicles used by the contractor shall be clearly marked with contractor's name. 4.0. CONTRACTOR'S RISKS 4.1 All risks of loss or damage to physical property and of personnel injury and death which arise during and in consequence of the performance of the contract other than the expected risks are the responsibility of the contractor. a) Loss of or damage to the works, plant and materials b) Loss of or damage to the Equipment c) Loss or damage of property (except the works plant, materials and equipments) in connection with the contract and. d) Personal injury or death. 4.2 Policies and certificates for insurance shall be delivered by the contractor to the Engineer for the engineer's approval before the start date. All such insurance shall provided for compensation to be payable in the types and proportions of currencies required of rectify the loss or damage incurred. 4.3 If the contractor does not provide any of the policies and certificates required, the Employer may effect the insurance which the contractor should have provided and recover the premiums the Superintending Engineer had paid from payments otherwise due to the contractor or, if no payment is due, the payment of the premiums shall be a debt due. 4.4 Alterations to the terms of insurance shall not be made without the approval of the Engineer-in-charge. 4.5 Both parties shall comply with any conditions of the insurance policies. SCHEDULE -D MATERIALS AND WORKMANSHIP 1.1 GENERAL 1.1.1 a) No Materials shall be used for construction in any work until notice has been given by the Executive Engineer that the test results are satisfactory. No oral instruction should be followed. b) Recommendation of stacking and storage of construction materials at site shall be in accordance with IS: 4082-1977. c) To be of the best Quality:- All materials, articles, and workmanship shall be the best of their respective kinds for the class of work described in the contract specifications and schedule. The word 'best' as used in the specifications shall mean, that in the opinion of the Executive Engineer there is no superior quality of material or finish of articles on the market and that there is no better class of workman ship available for the nature of the particular item described in the contract schedule. The contractor shall upon the request of the Executive Engineer, furnish him with the vouchers to prove that the materials are such as are specified. 1.1.2The tenderer has to do his own testing of materials and satisfy himself that they conform to the specifications of respective I.S.I. codes, before tendering. 1.1.3. The contractor shall himself procure the required construction materials of approved quality including the earth for formation of embankment and water from quarries/ sources of his choice. All such quarries/ sources of materials required for the work shall be got approved by the Engineer-in-charge in writing well before their use on the work. The materials as per standards of relevant I.S.I codes only will be accepted. 1.2. Samples: 1.2.1The representative samples of all materials should be procured by the contractor and arrange to send them to the Engineer-in-charge for conducting pre-construction tests and approval duly informing the source of materials from where he has collected the samples. 1.2.2 The raw and processed samples should be supplied at the contractor's expense to the Engineer-in-charge within 14 days after signing of the agreement. For testing of samples a maximum of 60 days time will be required. Each samples shall approximately consist of 100 kgs. of materials, or as directed by the Engineer-in-charge. 1.2.3 If the contractor desires to change the source of materials, he shall supply the raw and processed representative samples at his own expense to the Engineer-in-charge at least 60 days before its use for pre-construction tests and approval. 1.2.4 In addition to pre- construction tests and approval of quarries, the Engineer-in-charge may test the aggregate for their suitability during their processing. The contractor shall provide such facilities as may be necessary for procuring at no extra cost representative samples at the aggregate processing plant and at the batching plant. Final acceptance of the materials will be based on the acceptable test results of samples taken from the construction site only. 1.2.5 The contractor has to bear the cost of raw and processed representative samples, laboratory tests and filed tests. The contractor has to arrange the required men and material for collecting the samples and bear the cost thereon required for transporting them to the laboratory also. The contractor should quote his tender percentage for finished item of work for the items of works of Schedule 'A' keeping in view the cost of pre and processed samples to be submitted to the Engineer and also the rate of progress and the time required for conducting laboratory tests. No extension of time will be granted for any delay occurred in collecting the samples and conducting pre- construction tests in the laboratory and getting approval. 1.3 Procurement : 1.3.1 The rates quoted for all items shall include cost and conveyance of all materials with all leads. 1.3.2 It will be the tenderer's responsibility to satisfy himself that sufficient quantities of construction materials required for the works shall exist in the borrow areas or quarry sites. The Dept. does not accept any responsibility either in handing over the quarries or procuring the materials or any other facilities. The tenderer will not be entitled for any extra rate or claim for the misjudgment on his part for quantity and quality of materials available in the quarries. 1.3.3 Failure by the tenderer to have done all the things, which in accordance with this condition, he is deemed to have done, shall not relieve the successful tenderer of the responsibility for satisfactory completing the works as required at the rates quoted by him. 1.3.4The contractor shall make his own enquiries regarding the availability of other materials and make his own arrangements for procuring them. 1.3.5 The materials for embankment construction shall be obtained and got approved by the Engineer -in-charge. The responsibility for arranging and obtaining the land for borrowing or exploitation in any other way shall rest with the contractor, who shall ensure smooth and uninterrupted supply of materials for the quantity required in construction during the construction period. No separate cost will be paid. 1.3.6 Similarly, the supply of aggregates for construction shall be of approved quality approved by the Executive Engineer. Responsibility for arranging uninterrupted supply of materials from the source shall be that of the contractor. No separate cost will be paid. 1.3.7The contractor has to open and develop the quarry for the stone and aggregate required. All incidentals such as removal of over burden, stripping etc., in the quarry should be done by the contractor. The contractor shall make his arrangements for maintaining the approach roads to quarry for conveying the materials to site of work. 1.3.8 The contractors have to make their own arrangements for storage and conveyance of water and storage at work site for construction purpose. No extra payment will be made to the contractor over and above their tender rates for water lead for storage arrangement. 1.3.9The tenderer should inspect the site and check - up the possible water source for carrying out the entire work throughout the year in monsoon and non-monsoon season irrespective of the quantum of rainfall and quote their rates accordingly. No subsequent claims for extra water lead will be entertained under any circumstances. 1.3.10 The materials and labour utilized in the execution of work by the contractor shall not be less than that given in the A.P.P.W.D. standard data for the relevant item. 1.3.11 Lay-out of material stacks: The contractor shall deposit materials for the purpose of the work on such parts only of the ground as may be approved by the Engineer-in-charge. He shall submit, for the approval of the Executive Engineer, before starting work, a detailed site survey clearly indicating positions and areas where materials shall be stacked and sheds built. 1.4 DEFECTIVE MATERIALS: 1.4.1 All materials which the Executive Engineer/his representative has determined as not conforming to the requirements of the contract will be rejected whether in place or not. They shall be removed immediately from the site as directed. Materials, which have been found defective, and which have been subsequently corrected, shall not be used in the work unless approval accorded in writing by the Engineer-in-charge. Upon failure of the contractor to comply with any order of the Engineer-in-charge, given under this clause, the Engineer -in-charge shall have authority to cause the removal of rejected material and to deduct the removal cost thereof from any money due to the contractor. 1.4.2The rejected rubble and spoils should be dumped far away from work spot as directed by the Engineer-in-charge. The muck, boulders etc., fallen on the approach roads, ramps, etc. below the place should be removed by the contractor immediately after blasting at the contractor's cost. In case the above materials are not cleared within 24 hours of issue of departmental instructions, the same will be removed by the Dept. and the cost there of will be recovered from the contractor's bills. 1.4.3The Dept. will not be liable for any compensation due to breakdown in machinery, water supply or electricity or delay in supply of materials and for damage due to rains and floods. 1.4.4The Executive Engineer shall have power to reject at any stage, any work which he considers to be defective in quality of material or workmanship and he shall not be debarred from rejecting wrought materials by reason of his having previously passed them in an un-worked condition. Any portion of the work or materials rejected or pronounced to be inferior or not in accordance with the drawings and specifications shall be taken down and removed from the work-site at the contractor's expense, within 24 hours after written instructions to that effect have been given by the Executive Engineer. Replacement shall at once be made in accordance with the specifications and drawings, at the contractor's expense. 1.4.5In case of default on the part of the contractor to carry out such orders the Executive Engineer shall have power to employ and pay other persons to carry out the orders at the contractor's risk and all expenses consequent there on and incidental there to shall be borne by the contractor.
