General Terms and Conditions / Eligibility  
General Terms and Conditions / Eligibility 1. Bids are invited on the e-Procurement platform for the above-mentioned work from the contractors / contracting firms eligible as per clause 7, registered with Government of A.P. 2. Tender Schedules: Tender Schedules can be downloaded cost from the Web site www.apeprocurement.gov.in 3. Form of Contract: Lump sum contract. 4. Class of Contractor Eligible: Class IV as per G.O.Ms.No.94 PR & RD Date: 1-7-2003 or equivalent registration with State Government/Government of India/Government undertaking. The eligible intending bidders would be required to enroll themselves on the e-Procurement Market Place www.apeprocurement.gov.in and submit their bids online. Note: The tender opening dates stipulated are extendable by the department if it happens to be the Public Holidays or any other valid reason. 5. The tenderer is subject to be disqualified, if he is found to have misled or furnished false information in the forms/statements / certificates submitted in proof of qualification requirements or record of performance such as abandoning of work not properly completed in earlier contracts, inordinate delays in completion of the works, litigation history and or Financial failures. 6. Even while execution of the work, if found that the contractor had produced false/fake certificates of experience, he will be black listed and the contract will be terminated and his EMD will be forfeited. 7. TRANSACTION FEES: The participating bidder shall pay transaction fee of Rs. /- (Rupees Only) (including 15% service Tax) All tenders here to pay above non refundable transaction fee to M/s Vupadhi Technologies through electronic payment gateway of ICICI/HDFC banks with eprocurement platform, which provides a facility to participating suppliers/contractors to electronically pay the transaction fee from the platform using their credit cards. The fact is mandatory.

General Technical Terms and Conditions (Procedure) 1. If, any other condition regarding receipt of tenders in conventional method appearing in the tender documents may please be treated as not applicable. 2. The documents that are uploaded in the Internet only will be considered for Financial Bid Evaluation. 3. The Contractors are requested to upload the information in Zip format preferably. 4. The contractor shall be required to furnish a declaration in e procurement stating that the soft copies uploaded by him are genuine. Any incorrectness/deviation noticed will be viewed seriously and apart from canceling the work duly forfeiting the EMD, criminal action will be initiated including suspension of business. 5. All the uploaded documents furnished in support of eligibility for the tender, should be self attested by the tenderer. The tenderers need not to upload the tender schedules of volume-I & Volume-II in eprocurement, but they have to furnish the certificate in e procurement stating that I have gone through all the tender conditions and accepted them without any pre conditions. Non submission of this certificate will liable for rejection of the bid. 6. The successful (LI) bidder shall furnish the original hard copies of all documents/certificates/statements uploaded by him before concluding agreement. 7. The successful bidder shall pay an amount equivalent to 0.04% of ECV (estimated contract value) with a cap of Rs. 10,000 (Rupees ten thousand only) for all works with ECV upto Rs. 50 Crores on e-Procurement platform before entering into agreement/issue of purchase orders, towards e-procurement fund in favour of Managing Director, APTS, Hyderabad through the Agreement authority. 8. The tender conditions given in the Uploaded tender documents is only be considered. 9. Tenders up to 15% less than estimate will be accepted, but for tenders in excess of less than 15% of the estimate, a Demand Draft for the difference amount between the tendered amount and 85% of the estimate value will be taken at the time of Agreement. So that if the tenderer leaves the work midway and the department is forced to call for the works once again the Demand Draft shall be used to finance the re-tendered work. 10. Tenders can be post phoned, rejected or cancelled at any time by the tender inviting authority without any prior notice (or) without assigning any reason. Final decision in this regard lies with the tender inviting authority. 11. The Successful Contractor shall purchase the items like DI Butterfly Valves, sluice valves etc., manufactured by the local SSI units preferably. Special Condition 12. The Executing agency shall conduct survey for necessary investigation before grounding the work and to check the levels of Pipe line alignment, site for all structures/ components before execution. 13. There are any deviations or omissions observed, the hydraulic designs/statement shall be got approved by the Executive Engineer before execution. The detailed designs of all the structures, including foundation designs shall be got approved by the competent authority as per actual site conditions and soil test, before grounding the work.

Legal Terms & Conditions  
Legal Terms & Conditions 1. In case of any disputes or differences between the parties to the contract, the contractor should put his claims in writing within 15 days to the Chief Engineer, RWS, PR, Vijayawada for settlement. 2. For claims upto Rs.5.00 lakhs, the decision of the Chief Engineer, RWS, PR, Vijayawada is final and binding on both the parties. For claims in excess of Rs.5.00 lakhs, and if the contractor is not satisfied with the decisions of the Chief Engineer, RWS, PR, Vijayawada , for claims up to 5.00 lakhs he may ask the department in writing for arbitration within 30 days of communication of written decision. 3. The contractor may seek appointment of arbitrator from the panel of persons appointed by the department. 4. If the contractor does not refer the dispute to the department for arbitration within the above 30 days, the decision of the Chief Engineer (RWS) will be final.
