General Terms and Conditions / Eligibility
As per tender document

General Technical Terms and Conditions (Procedure)
1) Eligible Class of Contractors Registered as mentioned in tender documents. 2) Assessed available bid capacity as per formula (2AN-B) should be greater than the estimated contract value of Rs.61407433.00 3) Evaluation as per GO.Ms.No.66, dt.20.04.2015 4) Payment of Earnest Money Deposit: Each bidder must pay, as earnest money a sum of Rs.615000/- (1% of ECV). The mode of payment as mentioned in the "Procedure for Bid Submission" 5) Declaration of availability either owned or leased of the Key and critical equipment as shown in the bid document. For the equipment owned or leased, the Contractor should furnish a declaration on Rs.100/- Non judicial Stamp Paper. 6) Tenders with more than the estimated contract value shall summarily be rejected. 7) The cost of tender document is dispensed with 8) The bidders can download the tender documents free of cost 9) The validity of the tender is 90 days from the last date of submission of bid on online 10) The bidders should submit the following along with bid a) Copy of GST Registration certificate incorporating Tax Identification Number (TIN) b) Latest SARAL form submitted to IT Department with PAN Card c) Self declaration. 11) Even during the execution of the work, if it is found that the contractor had produced false/fake certificates pertaining to experience, qualification criteria or any other aspect, he will be black listed and his contract will be terminated. 12) Tender inviting/receiving authority reserves the right to postpone/cancel/reject any or all the tenders without assigning any reasons what so ever. 13) No tender shall bear any cause of action or claim against any officer of the department. 14) Tenders up to 15% less than the estimate may be accepted, but for tenders which are less by more than 15% of the estimate, a Demand Draft for the difference between the tendered amount and 85% of the estimate contract value should be taken so that the tenderer leaves the work midway and the department is forced to call for tenders for the work once again, the Bank Guarantee or Demand Draft shall be used to finance the re-tendered work. 15) The tenderer / bidder should have own or lease / hire agreement with Batch type Hot Mix Plant 100-120 TPH located within distance of 100Kms from last point of worksite on 100/- Non judicial stamp paper. The location ,distance & Ownership of plant should be issued by the concerned DPRE/EE PR and In case of Lease or Hire of Batch type HMP 100-120 TPH and Critical equipment , the Bidder/Tenderer should upload Lease agreement pertaining to the work/Package

Legal Terms & Conditions
The tenderer is subjected to be black listed and the EMD forfeited if he is found to have misled or furnished false information in the forms/statements/certificates submitted in proof of qualification requirements or record of performance such as abandoning of work not properly completed in earlier contracts, inordinate delays in completion of the works, litigation history and / or financial failures and /or participated in the previous tendering for the same work and had quoted unreasonable high bid prices. Even while execution of the work, if found that the contractor had produced false/fake certificates of experience he will be black listed and the contract will be terminated. All disputes or difference arising of or relating to the Contract shall be referred to the adjudication as follows: a) Claims upto a value of Rupees 10,000/-. - Regional Officer, (PR) Region, Mahabubnagar b) Claims above Rs.10,000/- and up to Rupees 50,000/-. - Engineer-in-Chief (PR) Administration, Hyderabad The arbitration shall be conducted in accordance with the provisions of Indian Arbitration and Conciliation Act 1996 or any statutory modification thereof. The arbitrator shall state his reasons in passing the award. Claims above Rs. 50,000/-. All claims of above Rs.50,000/- are to be settled by a Civil Court of competent jurisdiction by way of Civil suit and not by arbitration. The Contract shall make a reference for adjudication under this clauses shall be made by the contractor within six months from the date of intimating the contractor of the preparation of final bill or his having accepted payment whichever is earlier
