General Terms and Conditions / Eligibility
As per the BID DOCUMENT and Eligibilty criteria as mentioned in NIT

General Technical Terms and Conditions (Procedure)
1) Bids are invited on the e-procurement platform for the above-mentioned work from the Contractors/Contracting firms registered with Government of Telangana or Andhra Pradesh (erstwhile). The details of tender conditions and terms can be downloaded form the electronic procurement platform of Government of Telangana i.e., "tender.telangana.gov.in" 2) The Contractors would be required to register on the e-procurement market place "tender.telangana.gov.in" and submit their bids online. The department will not accept any bid submitted in the paper form. 3) E.M.D to be paid in the shape of through the Net Banking/RTGS/NEFT/Credit card/ Debit card in favour of APAO, Sangareddy or Bank Guarantee in favour of Superintending Engineer, R&B Circle, Sangareddy BG should be valid for a period of six month from date on NIT obtained from Nationalised / Scheduled Commercial Bank, at 1% of the estimated contract value of work along with bid documents. concerned as mentioned in 1st page of NIT Conditions and Bid document, along with bids and the balance EMD @ 1.50% of contract value to be paid at the time of concluding the agreement. Scanned EMD should be uploaded with the bids. 4) The bidders can view/download the tender document from the e market place. NOTE: (i)The dates stipulated above are firm and under no circumstances they will be relaxed unless otherwise extended by an official notification or happen to be public holidays. (ii) The Bank Guarantee submitted by the successful bidder at the time of tender with conditional obligations shall not accepted and retained against EMD for performance at the time of conclusion of contract. (iii) Unconditional and irrevocable Bank Guarantee shall be obtained towards EMD for the entire specified amount at the time of concluding agreement. 5) Qualification requirements and submission of Bids: To qualify for consideration of award of the contract, each bidder should fulfill the eligibility criterion and submit the information in the form of certificates or statements issued by the competent authorities as prescribed in the bid document. 6) The bidder should upload all the particulars invariably in the format specified in the tender document under Annexure I along with the necessary certificates, failing which, his tender shall be treated as incomplete and summarily rejected. 7) Available bid capacity as per formula (2AN-B) should be greater than the estimated contract value as specified in the eligibility criterion. All the necessary certificates are to be furnished and all the formats incorporated in the bid documents are to be filled with the supporting information available from the certificates enclosed. 8) The details and certificates are to be furnished as per the proforma/formats available in the bid document along with necessary certificates, failing which his tender shall be treated as incomplete and summarily rejected. 9) To pay E.M.D to be paid in the shape of through the Net Banking/RTGS/NEFT/Credit card/ Debit card in favour of APAO, Sangareddy or Bank Guarantee in favour of Superintending Engineer, R&B Circle, Sangareddy BG should be valid for a period of six month from date on NIT obtained from Nationalised / Scheduled Commercial Bank, at 1% of the estimated contract value of work along with bid documents. Procedure for BID Submission (a) Bidders need to contact the Superintending Engineer (R&B), Circle, Sangareddy for information on e-procurement. (b) Bidders need to register on the electronic procurement market place of Government of Telangana i.e., www.tender .telanagana.gov.in. On registration on the e-Procurement market place, they will be provided with a user ID and password by the system using which they can submit their bids online. (c) While registering on the e-procurement market place, bidders need to scan and upload the required documents as per the tender requirements on to their profile. (d) The bidder shall sign on all the statements, documents, certificates uploaded by him, owning responsibility for their correctness/authenticity. (e) The technical bid evaluation of the tenderers will be done on the certificates/documents uploaded through online towards qualification criterion furnished by them. (f) Submission of original Hard Copies of the uploaded scan copies of BG towards EMD by participating bidders to the tender inviting authority before opening of the price bid be dispensed forthwith. g) All the bidders shall invariably upload the scanned copies of BG in e- Procurement system and this will be the primary requirement to consider the bid as responsive. h) The Department shall carry out the technical bid evaluation solely based on the uploaded certificates/documents, BG towards EMD in the e- procurement system and open the price bids of the responsive bidders. i) The Department will notify the successful bidder for submission of original hard copies of all uploaded documents, BG towards EMD prior to entering into agreement. j) The successful bidder shall invariably furnish the original BG towards EMD, certificates/documents of the uploaded scanned copies to the Tender inviting Authority before entering into agreement either personally or through courier or post and the receipt of the same with in the stipulated date shall be the responsibility of the successful bidder. The Department will not take any responsibility for any delay in receipt/non-receipt of original BG towards EMD, certificates/documents from the successful bidder before the stipulated time. On receipt of documents, the Department shall ensure the genuinity of the BG towards EMD and all other certificates/ documents uploaded by the bidder in e-procurement system in support of the qualification criteria before concluding the agreement. k) if any successful bidder fails to submit the original hard copies of uploaded certificates/documents, BG towards EMD with in the stipulated time or if any variation is noticed between the uploaded documents and the hard copies submitted by the bidder, the successful bidder will be suspended from participating in the tenders on e-Procurement platform for a period of 3 years. The e- Procurement system would deactivate the user ID of such defaulting successful bidder based on the trigger/recommendation by the tender Inviting Authority in the system. Besides this, the Department shall invoke all processes of law including criminal prosecution of such defaulting bidder as an act of extreme deterrence to avoid delays in the tender process for execution of the development schemes taken up by the Government. The information to this extent may be displayed in the e-procurement platform website. (l) Steps for registration and submission of bids are described in detail in the Bidders Training Booklet available with the department as well as at the above web site. (m) The bidder shall mandatorily pay the transaction fee to MD TSTSL HYDERABAD TELANGANA through the electronic payment gateway. (n) Corpus Fund charges towards e-procurement services @ 0.04% of estimated contract value with a cap of Rs. 10,000/- for all works with estimated contract value up to Rs. 50.00 Crores and Rs. 25,000/- for works with estimated contract value above Rs. 50.00 Crores from successful bidder payable in the shape of online to Managing Director, TS TS, Hyderabad at the time of concluding the agreement. (o) Even while execution of the work, if found that the contractor had produced false/fake certificates of experience, he will be black listed and the contract will be terminated and the work will be taken over invoking clause 60 (a) of PS to APSS. (p) All the above information shall accompany with a check slip as prescribed Annexure I.

Legal Terms & Conditions
All disputes or difference arising of or relating to the contract shall be referred to the adjudication as follows: Claims upto a value of rupees 10,000 / - : Superintending Engineer, (R&B) Circle, Nizamabad a)Claims above value of rupees 10,000/- and up to rupees 50,000/- : CE(R&B), State Roads, Hyderabad The arbitration shall be conducted in accordance with the provisions of Indian Arbitration and Conciliation Act 1996 or any statutory modification thereof. All claims of above Rs.50,000/- are to be settled by a Civil Court of competent jurisdiction by way of civil suit and not by arbitration.
